These Donation Terms apply to all donations made to The Timmons Foundation through www.thetimmonsfoundation.org or through any online, electronic, or related donation method we make available. By making a donation, you agree to these Donation Terms.
1. Charitable Status
The Timmons Foundation is a 501(c)(3) nonprofit organization. Donations are intended to support our charitable mission and programs.

2. Use of Donations
Unless specifically designated and accepted as a restricted contribution, donations may be used where needed most in support of the Foundation’s mission, programs, operations, and charitable activities.
If a donor designates a gift for a specific program, campaign, or purpose, we will make reasonable efforts to honor that designation. If the designated use becomes unavailable, impracticable, or no longer aligned with operational needs, the Foundation may redirect the donation to a substantially similar charitable purpose consistent with its mission.
3. Donation Authorization
By submitting a donation, you represent and warrant that the payment method used is authorized, the information you provide is true and accurate, your gift is voluntary and made with donative intent, and the funds are lawful.
4. Payment Processing
Online donations may be processed through third-party payment processors, donation tools, or website service providers. We are not responsible for errors caused solely by third-party systems, banking networks, or processor outages, although we will try to assist in resolving issues when possible.
5. Recurring Donations
If you enroll in a recurring donation, you authorize the Foundation or its payment processor to charge your selected payment method automatically on the schedule you choose until canceled.
You may request cancellation of future recurring donations by contacting us at the email listed below or by using any donor management tools made available through the donation platform. Cancellation of future recurring donations does not entitle a donor to a refund of payments already processed, except as described below or as required by law.
6. Refund Policy
Donations are generally considered final and non-refundable. However, the Foundation may review refund requests on a case-by-case basis in situations involving duplicate transactions, unauthorized use of a payment method, clear processing errors, or other exceptional circumstances.
Any approved refund will be issued, when possible, to the original payment method used for the donation.
7. Tax Information and Receipts
The Foundation will provide a donation confirmation or receipt for online contributions. For contributions that qualify for tax substantiation, the Foundation intends to provide an acknowledgment containing the information reasonably necessary for donor records.
Donors are responsible for consulting their own tax advisors regarding the deductibility of any contribution.
8. Goods or Services
Unless explicitly stated otherwise in connection with a particular donation, sponsorship, event, or campaign, no goods or services are provided in exchange for a donation.
If goods, services, sponsorship benefits, event access, or other benefits are provided, the Foundation may describe them separately as part of the applicable campaign, sponsorship, or event materials.
9. Donor Privacy
Information collected in connection with a donation is subject to our Privacy Policy.
10. Fraud Prevention and Acceptance of Donations
We reserve the right to refuse, decline, return, or reverse a donation where reasonably necessary, including in cases of suspected fraud, legal concerns, compliance risks, or administrative error.
11. Changes to These Donation Terms
We may update these Donation Terms from time to time. Updated terms will be posted on this page with a revised effective or update date. Continued use of our donation tools after changes are posted constitutes acceptance of the revised terms.
